The California Attorney General publishes guidance, audit rules, and training for agency databases by July 1, 2026. It covers databases run by agencies and by private vendors for them. The guidance aims to limit access to personal data for immigration enforcement to the fullest practicable extent. It is developed with stakeholders and must follow federal and state law.
If the Commission on State Mandates finds this law creates state‑mandated costs, local agencies and school districts are reimbursed. Reimbursement follows the process in Government Code Part 7, starting at Section 17500.
The California Attorney General must publish model policies on agency contact with immigration authorities by July 1, 2026. State and local agencies must adopt the model or an equivalent policy by January 1, 2027. The policies are developed with stakeholders and must follow federal and state law. This sets uniform statewide rules for how agencies respond to immigration enforcement.
Policies the Attorney General issues under this law are not subject to the usual Chapter 3.5 rulemaking process. This speeds up issuing guidance and standards. It also reduces formal notice-and-comment steps for stakeholders.
