Stronger penalties for leaking sealed records

No one other than the petitioner may post these confidential records online. Beginning six months after this law’s effective date, you can sue to enforce the privacy rules. If you win against a private party, the court awards your attorney’s fees and costs. If someone with actual knowledge that your records were confidential shares them, you can sue for at least $5,000 or your actual losses, plus possible punitive damages and attorney’s fees.

Private court records for name and gender changes

The law keeps court records for name or gender changes confidential. Only you, people in the case, their lawyers, and written agents can see them. For minors, parents or guardians can also see them. This applies to petitions filed on or after July 1, 2026, and to earlier cases if you request confidentiality ex parte with no filing fee, or if records were already confidential. The court must grant that confidentiality request. Courts can still seal all records under existing rules. By July 1, 2026, the Judicial Council provides the forms and rules to make this work statewide.
