The law requires statewide guidance and county mailings to help foster youth file taxes and claim the foster youth tax credit. The department must issue guidance by July 30, 2026 and update it at least every two years. Each year between November 1 and January 31, counties must mail every nonminor dependent tax-filing information and credit details, including who qualifies and the maximum credit for the coming season. The mail must also list other credits (state and federal Earned Income Tax Credits, the federal Child Tax Credit and state Young Child Tax Credit, federal and state Child and Dependent Care credits, the federal American Opportunity and Lifetime Learning credits, and the state Renters’ Credit), how to find IRS‑certified VITA sites or county workshops, and free ways to self‑file.
Counties must follow these new duties only to the extent the state pays the extra costs each year under the 2011 Realignment. If the state does not provide money, counties are not required to cover unfunded new costs or higher service levels beyond the funded amount.
