Faster HOA approvals to rebuild homes

The law voids HOA rules that block a “substantially similar” rebuild after a disaster. A similar rebuild means you meet local code, keep livable area and height within 110% of before, keep the same footprint or have at least 4‑foot side and rear setbacks, and meet any objective design rules that do not unreasonably raise cost or block rebuilding. Reviewers must say if your application is complete within 30 days, or it is deemed complete. After that, they have 45 days to approve or return one full set of comments using the rules in effect at your first filing. If they say it is incomplete or not compliant, you can appeal and must get a final written decision within 60 days. Once approved, they cannot require more hearings or appeals unless you do not follow the approved plan. If you win a suit to enforce the covenant ban or the review timelines, the court awards your reasonable attorney’s fees.

Temporary home on your lot during rebuild

For three years after a disaster, local bans on placing a manufactured home, mobilehome, or RV on your private lot are unenforceable. This applies outside of mobilehome or special‑occupancy parks and only while you repair or rebuild your damaged home.

Streamlined city approval after disasters

The state creates a ministerial, no‑hearing approval path to rebuild housing on parcels hit by a disaster. Your project must meet objective zoning and design rules, follow set labor standards, and be no more than 110% of prior livable area unless a waiver applies. You must have owned the site on the disaster date, and historic or mobilehome‑park sites are excluded. The planning director must approve within 90 days if the plan meets the standards. If the city finds a conflict, it must send written reasons within 60 days for the first filing or 30 days after a resubmittal. If the director misses these deadlines, your project is treated as meeting the standards. After approval, the city may not take steps that chill or undo the approval.
