2030 flood protection for Natomas and Marysville

The law sets a 2030 deadline to reach the urban level of flood protection in named places. These include the Natomas subarea in and around the City of Sacramento, the Beach Lake subareas in the City and County of Sacramento, and the City of Marysville where protected by the Marysville Ring Levee. It also defines the exact boundaries of these subareas so everyone knows where the rule applies.

Stricter building approvals in flood zones

Cities and counties in the Sacramento–San Joaquin Valley face stricter approval rules in flood hazard zones. After required plan and zoning updates, they cannot OK development agreements, new buildings or occupancy, or subdivision maps unless they make one of four findings. They must show either: existing flood works already protect to the urban/FEMA level; project conditions will achieve it; the local flood agency has made adequate progress; or an undetermined‑risk area already meets the urban level. Urban areas behind project levees must meet the urban level by 2025, except where the law sets 2030.

Local share of flood damage costs

Cities and counties may have to pay a fair share of flood damage costs if they unreasonably approved new development that raised the state's liability. This applies to Marysville, Sacramento, Sacramento County, Sutter County, and Yuba County in the named subareas, and continues until the area meets the urban protection standard. A payment duty arises only if a lawsuit is filed against the state for flood damage and legal steps for contribution are met. There is no duty if the state settles without letting the local agency join the talks, and the law does not extend the time to challenge approvals. Local agencies do not have to contribute if, after the new approval rules take effect, they follow those rules, and projects filed before January 1, 2008 are exempt.
