The California Labor Commissioner can investigate when tips are taken or withheld. The agency can issue citations or file civil actions. It uses its standard citation and penalty process to enforce payment. This gives workers a way to recover owed tips and penalties from employers.
If you get tips, your employer cannot take any part of them or count them toward wages. Tips are your property. For credit card tips, your employer must pay the full amount and cannot deduct card fees. You must get those tips by the next regular payday after the customer authorized the card payment.
