To challenge the council’s adoption or change of the Delta Plan or its appeals procedures, you must file under Code of Civil Procedure Section 1085 within 90 days of the council’s final decision. To challenge the council’s decision on an appeal, you must file under Section 1094.5 within 90 days after the council adopts its written findings under Section 85225.25. This rule applies to any person or any state or local public agency.
