By January 1, 2026, the Department of Health Care Access and Information takes over and runs the Data Exchange Framework. The department can adopt program rules and agreements without using the Administrative Procedure Act and issues program notices instead. New or updated policies get at least 45 days of public review and 180 days of advance posting. The department can hire staff and sign contracts faster and without some standard state reviews. People hired for this work cannot have financial ties to required participants or to the framework.
The law requires many providers, plans, labs, and EMS to share or give access to health records in real time for treatment, payment, and operations. The department sets the technical rules. Most must sign the single Data Sharing Agreement by January 31, 2023; some groups, like certain medical foundations, have until July 1, 2026. Small providers and certain hospitals have until January 31, 2026, and facilities named in Section 1180.2(a) have until January 31, 2029. Starting July 1, 2026, compliance is required for contracts with the Department of Health Care Services, CalPERS, and Covered California. The real-time rule does not cover abortion or abortion‑related care, gender‑affirming care, immigration or citizenship status, or place of birth.
The department runs a stakeholder advisory group with up to 17 voting members and no financial conflicts. The group meets publicly and advises on data types, privacy, funding, and training. By January 1, 2027, it recommends how to collect individual‑level demographic and health‑related social needs data. The agency developed a secure digital ID strategy by July 31, 2022 to help match people across records. By July 1, 2027, the department reports to the Legislature on who has signed, compliance options, governance needs, support needs, and consumer experience.
The department provides training and technical help through experienced nonprofits and advisory members to entities in the framework. By July 1, 2026, it sets a process to designate Qualified Health Information Organizations as intermediaries. Providers and social service groups can meet their data‑sharing duties by working with a designated QHIO.
Beginning January 1, 2027, the department posts the names of entities that have not executed the data sharing agreement. Entities can add a short statement about extenuating reasons, and the department may notify licensing boards. The law allows enforcement rules only after the Legislature funds them and the required report is submitted, and any enforcement rules must follow the Administrative Procedure Act.
