You do not pay the surcharge when no filing fee is charged or your filing fee is waived. Collection of the surcharge stops when the bond costs are fully repaid, or 30 years after the bond sale, whichever comes first. The county must tell the superior court and the Judicial Council when that end point is reached. The legal authority for this surcharge ends on January 1, 2039 unless extended by a later law.
San Bernardino County may add up to $35 to certain court filing fees. It applies to the first paper in civil, family, or probate cases and special proceedings. It also applies to the first paper for a defendant, respondent, intervenor, or other adverse party. The county must give public notice, hold a hearing, and tell the superior court and the Judicial Council about any change.
The county must deposit all surcharge money in the Courthouse Construction Fund. The money can only pay for courthouse projects, including earthquake retrofitting, renovation, and remodeling at the Central San Bernardino Courthouse (the 1926 building and additions). Work paid with this money must prioritize needed earthquake retrofits. When the local surcharge is added, the state reduces the amount that would go to the State Court Facilities Construction Fund.
