Faster CEQA for wildfire rebuilds; applicants pay

Beginning January 1, 2027, CEQA lawsuits over covered wildfire rebuilds should finish within 270 days after the certified record is filed. The Judicial Council sets court rules to try to meet this timeline. Applicants must agree to pay trial and appeal court costs, and any special master the court orders. The record of proceedings must be prepared under state CEQA rules in section 21167.6.2(a). These rules apply in areas with a Governor-declared fire emergency on or after January 1, 2023, for projects to repair, restore, demolish, or replace wildfire-damaged property that follow local zoning, are proposed before the emergency is ended, and are not otherwise exempt from CEQA.

Limits on fast-track wildfire rebuild review

Starting January 1, 2027, only certain projects can use the expedited CEQA process. The project must follow local zoning and land use rules. It must be proposed before the Governor ends the emergency for that area. The area must have a Governor-declared fire emergency on or after January 1, 2023. The project must repair, restore, demolish, or replace wildfire-damaged property and cannot already be exempt from CEQA under state law or a Governor’s order. Projects that do not meet these limits must use the normal CEQA process.
