Registration expands for sex with minors

Beginning January 1, 2026, people convicted under Penal Code 261.5(c) or (d) must register if they live, work, or study in California. These cover sex with a minor more than three years younger, or being 21 or older with a minor under 16. The law keeps a close‑in‑age exception: you do not register if you were not more than 10 years older and this is your only registrable conviction. That exception also applies to certain related offenses (Sections 286(b), 287(b), and 289(h) or (i)). A court may still require registration in close‑in‑age cases.

Tiered registration rules and out-of-state cases

The law sets minimum registration times: 10 years for tier one, 20 years for tier two, and life for tier three. If your conviction is from another state, California matches it to the closest California offense and assigns a tier. If there is no match and your duty comes only from another state, you are tier two by default, or tier three for high risk or similar later offenses or prior SVP commitment. If DOJ cannot set your tier right away, it places you in “tier‑to‑be‑determined.” DOJ must decide within 24 months, and that time counts toward your minimum.

Most juvenile wards do not register

Wards of the juvenile court do not have to register under the Sex Offender Registration Act. They must register only if Penal Code 290.008 specifically requires it.

Registration for certain solicitation repeat offenders

Beginning January 1, 2025, an adult convicted of the listed solicitation offense must register if they have the specified prior conviction. This applies when the person was more than 10 years older than the minor and this is the only registrable conviction. A court can still order registration.

Time rules and penalties for registrants

Your minimum registration time starts when you are released. Time is paused while you are jailed, placed, or committed. Arrests without conviction do not pause time. Each misdemeanor failure to register adds 1 year. Each felony failure to register adds 3 years. A new registrable conviction restarts the minimum after release.
