The law lets you sue when someone knowingly uses your name, voice, signature, photo, likeness, or a digital replica without consent. You can get the greater of $750 or your actual losses, plus profits tied to the use. You can show gross revenue from the use; the other side can deduct expenses. Courts may add punitive damages and award attorney’s fees to the winner. You can also ask a court to order removal, and the removal must be finished within two business days of service unless the order sets a different deadline. A photo can be a still image, video, or live broadcast where you are readily identifiable, and using a commercial medium is not automatically allowed just because it has ads. These remedies stack with other legal remedies.
Consent is not required for uses tied to news, public affairs, sports, or political campaigns. Owners or employees of newspapers, TV, radio, cable, billboards, and similar media are not liable for offending ads unless they knew about the unauthorized use. If an employee’s image in an ad is only incidental and not essential to the ad’s purpose, the law presumes the employer did not knowingly violate consent. That presumption can be challenged with evidence.
This law includes a timing rule with Senate Bill 11. Section 1.5 takes effect only if both laws are enacted and effective on or before January 1, 2026, both amend Civil Code section 3344, and this bill is enacted after Senate Bill 11. If all three are true, Section 1.5 replaces Section 1. If not, Section 1 remains in effect.
