Final report on water supply and claims

After investigations end and the claim deadline passes, the board prepares a report. It describes the water supply and lists each claimant’s water-right claim. This creates a clear record for the adjudication.

Claimants face detailed checks and duties

If you filed notice to claim a water right, the board investigates your use in detail. It must consider all relevant information, including reports under Sections 1840 and 1841. Field inspections can occur after 30 days’ written notice, and you or an authorized agent must be present. You must provide all pertinent facts on your use and the basis of your right. After the investigation, the board mails you a blank proof-of-claim form and the factual findings to help you complete your claim.

New reporting orders and inspection powers

If earlier reports are not enough, the board can order anyone who diverts, uses, or claims water to submit technical or monitoring reports. You must respond within 75 days, and the order can require yearly updates while the case is pending. You can ask for more time for good cause, and the board cannot unreasonably deny it. The board must explain in writing why the information is needed and keep the burden in line with the benefit. It can require cost-sharing if separate reports would duplicate effort. The board may inspect property and get an inspection warrant when needed.

Nonfilers can claim after board review

The board investigates known water users who did not file a notice of intent. These users can be inspected without prior notice and do not have to be present if not notified. After the detailed review, the board sends them the findings and a blank proof-of-claim form. They can then file a claim on the same basis as timely filers.
