If you do not fix a marking problem within 14 days after notice, you face fines. The first uncorrected violation is $100, the second is $500, and each later one is $1,000. Each unmarked bin is its own violation. The Attorney General, a district attorney, or a city attorney can enforce this. Fines go into the state’s Accident Prevention and Road Safety Fund. Local governments are not treated as owners for these penalties.
Manufacturers and other owners must add reflectors on both sides of large trash bins and storage containers set on the curb for pickup. This applies only to units longer than 3 feet and taller than 4 feet, including those sold, rented, or supplied as part of a paid service. Most bins need at least eight strips of fluorescent yellow reflective tape, each at least 2 inches by 2 feet, meeting ASTM D4956-13 Type V, VIII, IX, or XI, placed at the top and bottom of all four corners. If corners will not take tape, place strips near the top and bottom or on the center of the smaller outside walls. Truck‑moved containers may use fluorescent yellow, red, white, or alternating red/white tape that meets ASTM Type IX or XI. Reflectors installed before January 1, 2025 do not need to be re‑positioned. Owners must also put their name and current phone number on the bin while it is out.
