Beginning December 31, 2026, tampon and pad makers must keep data on lead, arsenic, cadmium, and zinc in their products. The California Department of Public Health can add other chemicals that are found in products and shown to harm health. The department can set testing methods and lab standards, and it can post results and health info online. When it adds chemicals under this law, it does not use normal Administrative Procedure Act rulemaking.
On request, manufacturers must give the department their test methods and lab results for tampons and pads. The department may test products itself or through a third‑party lab. Makers must pay for testing before it happens. The department deposits these charges into the T.A.M.P.O.N. Act Fund. It can use the money only after the Legislature appropriates it.
