Officials must report $5,000 behests

Elected officers and Public Utilities Commission members must report behested payments when one source totals $5,000 or more in a calendar year. The report is due within 30 days after the total reaches $5,000. Once the threshold is met, all payments from that source that year must be reported within 30 days of the threshold or the payment, whichever is later. It applies when the officer asked for the payment, gave no equal value in return, and the payment is mainly for a legislative, governmental, or charitable purpose; for legislative or governmental purposes, the payer must be a non‑government source. Reports, filed with the official’s agency, are public and must list payer and payee names and addresses, amounts, dates, any goods or services, and the purpose or event; state agencies send copies to the Fair Political Practices Commission within 30 days, and local agencies forward copies to the local campaign filing officer.

Coordination with AB 808 amendments

This law coordinates its changes with AB 808. If both laws amending the behested‑payment section take effect by January 1, 2026 and this law operates first, this version applies only until AB 808 becomes operative. At that time, the mirror text in Section 1.5 takes effect.

Public appeal exception with conflict limits

Payments made because of a public appeal on TV, radio, billboards, online messages, or a public speech are not reported as behested payments. The speech exception does not apply at a known fundraising event if the officer agreed to speak, was featured in a solicitation, or publicly asked for donations. The exception also does not apply if the payee is not a government agency and the officer, their immediate family, campaign staff, or office staff holds a role there, such as board member, executive, founder, salaried employee, or honorary or advisory member. If the officer did not know a payment was in response to their public appeal, the 30‑day filing clock starts when they first learn that fact.
