The law raises criminal and civil penalties for conspiracies against trade. A corporation can be fined up to $6,000,000, or more if twice the illegal gain or twice the loss to others is higher. An individual faces prison for 1, 2, or 3 years, or county jail up to one year, and a fine up to $1,000,000 or twice the gain or loss. Each violation can also carry a civil penalty up to $1,000,000 in a lawsuit by the Attorney General or a district attorney. When setting civil penalties, courts consider seriousness, how long it lasted, willfulness, the defendant’s assets, liabilities, and net worth, and cooperation in the case.
Actions under this law must start within four years after the last act in the violation. Courts deposit all fine and penalty money with the county treasurer. If the Attorney General prosecuted, 100% goes to the state’s antitrust account; if a district attorney prosecuted, 100% goes to that county; for joint cases, money is split as the agencies agree and the court approves. Civil penalties accrue only to the State of California or the county where the court sits. Remedies and penalties under this chapter are cumulative with other state‑law remedies unless the statute says otherwise.
