The law defines a migrant agricultural worker family as one where at least one person earned 40% or more of the family’s gross income from fishing, agriculture, or related work in the 12 months before applying. Children in these families are enrolled in state child care by this order: (1) families that move from place to place; (2) families that moved within the last five years and still rely on farm work but are now settled near farm areas; (3) families in rural farm areas who rely on seasonal farm work; and (4) the federal Migrant Child Development Program follows federal rules. The department must use the same income self‑certification process here as in other state child care programs, which cuts paperwork. These rules apply to enrollment in state child care and development programs.
