People allowed to catch bail fugitives may not pretend to be police or use badges, uniforms, or words that suggest government authority. They may wear clothing labeled "BAIL BOND RECOVERY AGENT," "BAIL ENFORCEMENT," or "BAIL ENFORCEMENT AGENT" in letters at least two inches high. They cannot use their role for immigration enforcement or share personal information for that purpose, unless a judge issues a valid warrant or court order.
A peace officer may ask someone claiming to be an officer to show identification when the officer has probable cause or reasonable suspicion of a crime, including impersonation. The law also makes online or electronic impersonation of police, firefighters, utility workers, and other public officials a misdemeanor when done to defraud.
Beginning January 1, 2026, every California law enforcement agency must keep and publicly post a written visible‑ID policy. When doing enforcement, officers must show ID that lists their agency and either a name or badge number. Policies must list narrow exceptions, like undercover work, certain plainclothes assignments, safety gear that blocks ID, emergencies, SWAT or protective details, and specific safety threats. The policy must allow a verified written challenge and give a 90‑day chance to fix the issue before court review. A willful, knowing failure to display required ID is a misdemeanor, unless the agency already maintains and posts the required policy.
If you sell real law enforcement or firefighting uniforms, you must verify the buyer’s employment using an agency photo ID. If the agency has no photo ID, get a letter of authorization plus government photo ID. Selling without checking is a misdemeanor with fines up to $1,000 per sale. Making or selling a badge that looks like an official badge or falsely claims to be authorized is a misdemeanor with fines up to $15,000. Prop use for film, TV, video, or theater is allowed only with prior written permission from the named agency.
