Stronger privacy for your health data

The law treats your immigration status and birthplace as medical information when a provider or plan collects it. Providers, plans, and contractors cannot share or sell your medical info without your OK, and cannot use it for immigration enforcement unless a law allows it. Covered health apps and websites that collect reproductive, sexual, or mental‑health data must limit how they use and share it. Marketing is tightly limited: paid messages must name who pays in at least 14‑point type, offer a toll‑free opt‑out, and stop within 30 days after you opt out. Providers cannot honor foreign subpoenas without a California court order, and records for sensitive services get extra privacy.

Hospitals limit immigration agents access

Staff must route any immigration‑enforcement request for site or patient access to managers or legal counsel right away. Facilities must mark treatment and privacy areas as nonpublic, and deny access unless there is a judicial warrant or court order that specifically allows entry. Hospitals and clinics must train staff, monitor and document visitors, and are encouraged to post a notice to authorities at entrances. If access is denied, staff should have a witness and make a written record. Covered providers must put these steps in place within 45 days of the law’s effective date.

Which health facilities must follow rules

These rules apply to publicly funded hospitals, clinics, and health systems; private providers are encouraged but not required to follow them. The law defines which facilities count as health care provider entities. It defines immigration enforcement to include federal civil immigration actions and certain criminal immigration laws about entry, presence, or work. People in lawful custody and companions can still enter nonpublic areas to get or provide needed care. If the state requires local agencies to spend money, reimbursement follows existing rules when the Commission on State Mandates finds a mandate.
