Involuntary antipsychotic treatment in county jails

The law lets jail doctors give antipsychotic medicine in an emergency for up to 72 hours to adults found incompetent on a misdemeanor. To continue past 72 hours without consent, a psychiatrist must ask the court during the first 72 hours. A judge may order ongoing treatment only with clear and convincing proof: a treatable mental disorder, grave disability, lack of capacity, likely serious harm, and no less‑intrusive option after trying to find a community bed. Before any order, you get written notice, a lawyer, access to records, and a chance to attend, present evidence, and question witnesses. If no community bed exists, only noncustody health staff can give the medicine, and they must check you at least every 15 minutes for one hour. Orders end at the earliest of 90 days after the incompetency finding, 90 days after referral, another court order, or release, and the court reviews them at least every 60 days. The jail cannot keep you longer just to medicate. You can challenge the order by habeas corpus and you keep the Article 7 mental‑health rights. These rules end on January 1, 2030.

Jail transfers for 72-hour psychiatric care

A jail official or judge can send a person in custody who may have a mental health disorder to a 72‑hour evaluation and treatment facility. The jail or court must give confidential written reasons and notify the local mental health director, the prosecutor, and defense counsel. The person may switch to voluntary inpatient care without new court or jail consent, and the facility must report that change to all parties. Time in the facility counts toward the sentence. If the facility leader says arraignment or trial would harm the person, that facility time does not count toward court deadlines. Evaluators must judge basic needs based on life outside jail, not on jail food, shelter, or care. The facility must send confidential reports to the jail or judge and the local mental health director, and these rules cover jails and juvenile detention facilities defined in the law.
