Everyone else who meets the law’s test for a “covered person” must follow the state’s consumer finance rules. If you offer consumer financial products or services and are not covered by an exemption, you are subject to these requirements. The state Commissioner can still take action under Section 90003 even against firms that are otherwise exempt.
Some financial firms are exempt from the state’s consumer finance law when they act under another license. Escrow agents; finance lenders and brokers; mortgage originators and servicers; broker‑dealers and investment advisers; check sellers and bill payers; capital access companies; and entities under the Financial Institutions Law are exempt while working under their DFPI licenses. Their employees are also exempt for that licensed work. Banks, credit unions, and similar institutions under federal or other‑state charters, and licensees of other California agencies, are also exempt when acting under those authorities.
