Sales tax break for approved projects

The law excludes sales and use tax on leases or title transfers of property that make up an approved project. Since 2018-09-21, it also covers property transferred to a contractor when used as an integral part of the project's construction. To qualify, the property must be part of a project approved by the Authority. This exclusion ends on 2028-01-01.

Report on jobs and environmental impacts

The Authority must report to the Legislature by 2027-01-31. The report reviews the sales and use tax exclusion’s net effects on jobs and economic output. It also reviews net environmental effects. This reporting rule ends on 2028-01-01.

Authority can refinance project debt

The Authority can issue refunding bonds to refinance its debt or other public agency debt. It can pay redemption premiums and accrued interest, and fund some project additions or improvements. The Authority may hold and invest bond proceeds in escrow until they are used. Before refunding debt it did not issue, it must find the project qualifies under current law through 2027 and under updated references on 2028-01-01.

Clear project rules and 2028 timing

The law sets clear definitions for terms like project, advanced manufacturing, and participating party. The Authority uses these definitions through 2027. On 2028-01-01, the sales and use tax exclusion section switches to updated definition references. The temporary definitions expire on 2028-01-01.
