If a local agency does not send its ADU rule to the state within 60 days, or does not answer within 30 days, that rule is void. The local agency must then use state ADU standards to approve ADUs until it adopts a compliant rule and submits it. If an agency ignores the state’s findings, the housing department can alert the Attorney General. Before doing so, the state may consider if the agency had a compliant ADU rule between January 1, 2017 and January 1, 2020.
Cities and counties that pass ADU rules must send them to the state within 60 days. The housing department reviews the rules and issues written findings. If the state finds problems, the local agency gets up to 30 days to respond. The agency must either fix the rule or keep it and explain in its adopting resolution why it still follows state law.
