Stronger disaster price protections for Colorado shoppers

Colorado expands its disaster definition to include trade disruptions and unusual market disruptions affecting production, distribution, or consumption. These events must involve actual or threatened widespread or severe harm to people or property. During a governor-declared disaster emergency, the new price rule applies only when the declaration specifically cites section 6-1-730(2.5). For goods and services already listed in the price-gouging law, increases above 10% count as price gouging—a deceptive trade practice. This covers both sales and offers to sell. Prices are compared with the seller’s pre-disaster prices for similar goods or services. When that seller had no similar offerings, the comparison uses a similarly situated seller’s pre-disaster prices. The law applies to conduct on or after its effective date: 12:01 a.m. the day after the 90-day period following final legislative adjournment expires. A referendum petition filed within that period delays the challenged provisions until voter approval in November 2026 and the governor’s official declaration of the vote.
