Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Utilities and local governments can count nuclear

Colorado now counts nuclear power as clean energy for local-government authority and utility carbon-cutting rules. The utility definition covers electricity generation or storage without carbon dioxide emissions. Nuclear projects awarded funding through U.S. Department of Energy advanced nuclear reactor programs are expressly included. The law sets no household payment or electricity rate. It takes effect the day after 90 days following final legislative adjournment, unless a valid referendum petition delays it. With such a petition, it takes effect only after voter approval in November 2026 and the governor’s declaration of the vote.

Nuclear projects excluded from clean-energy tax classification

Colorado’s property tax definition follows the broader clean-energy definition but specifically excludes nuclear energy. Nuclear property therefore does not qualify through that clean-energy classification. The law sets no tax rate or property value and does not specify how an owner’s tax bill changes.
