Risk checks and help for abuse victims

Beginning July 1, 2027, Colorado officers responding to domestic violence must use a validated, evidence-based screening tool with standard questions. They must include the completed assessment in the incident report. Exceptions apply when the victim is unavailable, absent, or incapacitated, or when screening is impossible or impracticable. Officers must immediately contact a community-based victim advocate by phone or in person when screening shows high risk. This also applies when officers find high risk based on the full circumstances, even without a high-risk screening result. They must offer the victim a chance to speak with the advocate. These duties cover state-certified officers handling initial reports, not parole or probation officers.

Legal protection for good-faith risk assessment work

The law does not impose criminal, civil, or administrative liability for good-faith actions or omissions related to risk assessments. This includes giving, interpreting, or using an assessment, deciding whether to give one, or declining to use one. The protection applies only to good-faith conduct related to these assessments.

Officer training and tracking for abuse response

Colorado's Attorney General must develop officer training with a Colorado-based coalition that supports domestic violence survivors. Training must cover risk assessments, victim referrals, and language access, and be available by June 1, 2027. Beginning July 1, 2027, agencies must ensure covered officers are trained; officers trained before that date need no repeat training. Agencies using assessments must annually report domestic violence incident totals, assessments completed, and assessments finding high-risk victims to the Attorney General. Starting January 2028, the Attorney General's annual legislative presentation must report incidents, assessments, high-risk victims, and referrals. By January 31, 2030, the Domestic Violence Fatality Review Board must evaluate assessments and referrals. It must send its findings to the House and Senate Judiciary Committees or their successors.
