Patients get medical record access protections

Beginning August 12, 2026, Colorado health-care facilities and providers must invoice valid medical-record requests within 30 days. They must provide records upon payment. If they cannot provide access within 30 days, they can take 30 extra days with written notice during the initial period. Missing the deadline or required extension notice makes the records free. An outside event that makes delivery impossible or impractical can excuse delays and the free-record rule. The response clock starts when that event ends; written notices are due within five business days of learning about it and its resolution. Providers must deliver records electronically when requested, if the originals are electronic, readily producible electronically, and applicable fees are paid.

Patients get caps on attorney record fees

Beginning August 12, 2026, Colorado facilities and providers can charge at most $400 total for qualifying attorney requests exceeding 664 pages. The attorney must represent the patient or personal representative and provide a HIPAA-compliant authorization, valid subpoena, or valid court order. The cap does not apply when protected health information must be separated, withheld, or redacted to follow the law. Starting January 1, 2028, the cap adjusts each even-numbered January using the Denver-Aurora-Lakewood consumer price index. Adjustments use the All Items index for All Urban Consumers, or its successor, round to the nearest dollar, and never fall below $400. The Secretary of State publishes the adjusted cap by October 1 before it takes effect. For third-party requests of 664 pages or fewer, charges cannot exceed reasonable fees allowed under federal HIPAA rules. The law does not require release of privileged, confidential, or otherwise legally protected information.
