Rehire options for BOCES retirees, two-year wait
The law lets a retired BOCES executive director be rehired and get pay without a cut to PERA benefits. The employer must declare a critical shortage for that role and confirm the retiree has the needed skills. You must not have worked for an employer during the month your retirement took effect, or PERA reduces your benefit under its normal rule. If you retired before full service age and credits, you cannot work for your last employer in the same school division for two years. The law defines a BOCES executive director as the person with executive authority to run a BOCES and adds that role to the allowed rehire list.
Schools can send funds to BOCES
A local education provider can choose to have some or all startup and sustain funding paid directly to a BOCES. This changes who gets the payment, not the total amount.
