Faster child abuse reporting and interview coordination

Colorado law enforcement agencies and officers must send covered child-offense allegations to a child advocacy center within one week of receiving a report. This covers local law enforcement, the State Patrol, and the Colorado Bureau of Investigation. The reporting duty applies to offenses listed in state law, section 18-3-411(1). The center must be in Colorado, generally in the judicial district where the alleged crime occurred. For crimes reported in another jurisdiction, the receiving agency or officer determines the appropriate jurisdiction. If unusual circumstances prevent timely reporting, law enforcement must explain them to the center when reporting. Law enforcement must coordinate a forensic interview with the center when it considers one necessary and appropriate, following state interview requirements. The law does not set a deadline for investigations or interviews.

More video testimony for vulnerable witnesses

The law expands private video testimony from children under 12 to children under 18 at trial. It also covers witnesses with an intellectual and developmental disability as defined by state law. The law presumes these witnesses suffer serious distress or trauma when testifying in court with the defendant present. That presumption can be challenged with evidence. A judge may allow testimony outside the courtroom when testifying with the defendant present causes serious emotional distress or trauma. A party may request this option, or the court may act on its own. The judge must record findings about the witness's ability to testify in court and with the defendant present. The video system must carry direct, private audio and video, without public broadcast; digital and wireless systems qualify.
