Longer deadline for mental health follow-up

After an emergency mental health hold, facilities must try to contact the discharged person, their parent, guardian, or support person. The deadline changes from 48 to 72 hours after discharge, excluding weekends and holidays. Facilities are encouraged to use peer support workers and develop a continuing care plan. Follow-up can use community behavioral health providers or the 988 crisis hotline. Facilities must get the person's permission when arranging follow-up through a third-party contract.

Behavioral health providers face new licensing rules

Colorado's Behavioral Health Administration must receive a building fire-safety certificate before issuing or renewing a provider's license. The certificate generally comes from the state's Division of Fire Prevention and Control. Telehealth-only providers are exempt; outpatient-only providers can get certificates from a fire department that employs a certified inspector. The administration must act within 30 days after receiving all required application information and documents. The law's general start is 12:01 a.m. the day after the 90-day period following final legislative adjournment ends. The text lists August 12, 2026, for a May 13, 2026 adjournment. A referendum petition filed within that period delays challenged provisions until voter approval at the November 2026 election and the governor's official declaration.
