Coroners report test results after fatal crashes

When Colorado's Department of Transportation requests them, coroners and similar officials must electronically send crash-death alcohol and drug test results. This covers every person who died from a motor-vehicle crash within the official's area. Reports are due by the last business day of the quarter when the person died. If needed results are unavailable, reporting moves to the next quarter when complete results are available. Reports include all available results, including blood alcohol levels, drug screening panels, and sample collection dates, times, and sources. Identifying details are limited to those needed for federal reporting. This replaces monthly reports of crash deaths and circumstances. The law starts at 12:01 a.m. the day after the 90-day period following the legislature's final adjournment. That means August 12, 2026, if final adjournment is May 13, 2026. If a referendum petition is filed, the law takes effect only after voter approval at the November 2026 general election. In that case, it starts on the date of the governor's official declaration of the vote.
