Medicaid cannot pay for AI psychotherapy

Beginning January 1, 2027, Colorado Medicaid and the Children’s Basic Health Plan (CHP+) cannot pay for AI-delivered psychotherapy. The restriction covers care delivered directly to a person and conducted by an artificial intelligence system. If a referendum petition is filed within 90 days after final adjournment, voter approval in November 2026 is required. If approved, the rule starts January 1, 2027, or when the governor officially declares the vote, whichever is later. This payment restriction does not itself ban people from using these services or require them to pay for them.
