Colorado employers face new workforce reporting

Beginning July 1, 2027, private employers doing business in Colorado with at least 100 workers face new reporting requirements. Covered employers must include workforce data in their required periodic reports to the Colorado Secretary of State. Workers are employees under Colorado wage law. The data covers race, ethnicity, gender, and job category, using the federal EEO-1 form as it existed March 1, 2026. State reporting remains required even if the federal government ends its EEO-1 requirement. Federal, state, and local governments, school districts, state higher education institutions, quasi-governmental entities, and state political subdivisions are excluded. A referendum petition filed within 90 days after the legislature's final adjournment blocks the challenged provisions unless voters approve them in November 2026. Following voter approval, those provisions take effect July 1, 2027, or when the governor officially declares the vote, whichever is later.
