Updated emergency medication rules for behavioral health

The law updates which behavioral health facilities can receive emergency kits or starter doses from registered prescription drug outlets or other outlets. Eligible facilities must be licensed by Colorado’s Behavioral Health Administration, and board approval to receive an emergency kit remains required. This replaces the reference to acute treatment units licensed by the Department of Public Health and Environment. The law provides no direct payments to patients or new funding. It takes effect at 12:01 a.m. the day after the 90-day period following the legislature’s final adjournment ends. That date is August 12, 2026, if final adjournment occurs on May 13, 2026. If a referendum petition is filed, voter approval at the November 2026 general election is required. In that case, the law takes effect on the date the governor officially declares the vote.
