More time for Colorado farm bonds

The Colorado Agricultural Development Authority’s annual deadline to return unused or excess tax-exempt bond allocations moves from September 15 to November 15. Other state bond authorities keep the September 15 deadline. The Authority or its assignee can use an allocation by issuing bonds before November 15. To preserve it for a future-year project, they must send the administering Department written notice and required attachments before that date. The project must be identified in a formal bond resolution with a carryforward purpose. Unused allocations automatically return to the statewide pool unless an exception applies. Excess amounts must also return by the applicable deadline, including amounts above bonds issued or covered by a mortgage credit certificate election. Authorities can voluntarily return any portion at any time by written notice. This changes financing timing, not household payments or eligibility. The effective date is August 12, 2026, based on a May 13 session adjournment and the required 90-day waiting period. A timely referendum petition suspends the law until voter approval at the November 2026 election and the governor’s official declaration.
