Overtime pay for Colorado farm workers

Beginning January 1, 2027, Colorado farm employers must pay eligible workers overtime for hours beyond 56 in a workweek. The law does not specify the overtime rate. Workers mainly raising livestock on the open range are exempt. Qualifying decision-making managers are also exempt. These managers must mainly do agricultural work, meet Colorado's applicable minimum salary threshold, and not be seasonal or temporary employees. Their main duties must require regular independent judgment on important matters. They must also supervise at least two full-time employees or report directly to an owner or a qualifying executive. That executive must report directly to an owner and regularly use independent judgment on important matters in manual or nonmanual work. Family members of a family owner are also exempt, whether related by blood, adoption, or marriage. These include children, siblings, spouses, parents, aunts, uncles, nephews, nieces, first cousins, grandchildren, and grandparents. The rule covers time worked and contracts entered into or renewed on or after January 1, 2027.
