Tank owners face approved higher liability limits

Beginning August 12, 2026, petroleum underground tank owners or operators can exceed the Petroleum Storage Tank Fund’s $2 million per-incident liability limit. Both Colorado’s Division of Oil and Public Safety director and the Petroleum Storage Tank Committee must approve. When they approve, they must set a new maximum liability amount for that owner or operator. The law does not specify that new amount. The start date is subject to the act’s referendum petition and approval conditions.

Fuel suppliers can get fuel standard exceptions

Class I, II, and III liquid fuels must meet the latest applicable ASTM industry standards, unless law or rules modify them. For gasoline blended with ethanol, the base gasoline must meet ASTM D4814 before blending. The blend must meet that standard’s vapor pressure limit. Blends with 9% to 10% ethanol may exceed the limit by up to 1.0 psi. Retailers cannot blend Class I fuels with casinghead, absorption, condensation, drip, or natural gasoline. Beginning August 12, 2026, Colorado’s Division of Oil and Public Safety director can grant exceptions through rules or policy guidance. Exceptions can address fuel access, consumer protection, pricing, supply networks, and other factors ASTM did not consider. The law itself grants no specific exception and sets no fuel price. The start date is subject to the act’s referendum petition and approval conditions.
