Online betting operators cannot send Colorado account holders phone alerts or texts asking them to bet or deposit money. Operators and marketing affiliates cannot target people under 21 or make ads clearly aimed at them. They also cannot advertise in media reasonably expected to have a majority audience under 21. That media rule has an exception for public venues where attendee ages cannot be determined. Broadcasters are not treated as marketing affiliates.
Operators must report required information to Colorado’s Division of Gaming as soon as practicable. They must report designated information to the relevant sports governing body at the same time. Operators and the division must make reasonable efforts to help sports governing bodies investigate and must cooperate with law enforcement. Cooperation includes providing or arranging access to account-level betting records and available audio or video. Information shared with sports governing bodies and operators can be used only to protect the sport’s integrity.
Operators must submit betting transaction data and measures to Colorado’s Division of Gaming each year for the prior calendar year. Submissions begin no later than February 1, 2028, and are due every February 1 after that. Submitted data must exclude information identifying people and is exempt from Colorado public records requests. The division must publish a combined report by January 1, 2029, and every three years afterward.
For state fiscal years starting on or after July 1, 2024, the law sets a floor for water-planning transfers. Transfers from remaining sports betting fund money to the Water Plan Implementation Cash Fund must match or exceed the prior year’s transfer. This applies only to the extent the fund has enough unspent money not already committed. The law states no specific transfer amount or direct household payment.
Online sports betting operators cannot accept more than six deposits per person during a gaming day. Operators set that day as a continuous 24-hour period; the law sets no dollar cap on deposits. Operators cannot accept credit-card deposits, including money from an account funded by a credit card. These rules add safeguards against repeated or credit-funded deposits but limit bettors’ payment options. Credit-card violations are a Class 2 misdemeanor, and the state gaming commission can fine operators up to $25,000 per violation.
