Faster approval for municipal and co-op plans

If a municipal utility or cooperative files a voluntary clean energy plan, it is deemed approved by the Public Utilities Commission when two things are true. The state division publicly verifies the plan shows at least an 80% cut by 2030 from 2005 levels, and the utility’s governing body already approved the plan. This speeds approval for verified, board-approved plans.

City utilities aim for 95% cuts by 2039

For a utility that files an updated plan, its governing body must direct it to seek a 95% cut in emissions from 2005 levels by December 31, 2039. The utility must also seek to lower total emissions, from when it first reaches the 80% cut through December 31, 2035, compared with its original plan. These efforts must not impair the electric reliability standards of the regional grid operator.

City utilities must stop coal by 2032

If a municipal utility files an updated plan, it must stop burning coal at any coal unit it owns or operates by December 31, 2032. This rule applies even if other commission rules set different dates.

Updated targets and reporting for city utilities

A municipal utility with past plan challenges must file an updated clean energy plan by December 31, 2026. Its board must approve the plan. The plan must show an 80% cut in emissions from 2005 levels by the earliest date on or after December 31, 2029, and no later than December 31, 2032. The plan must include a detailed generation and transmission plan, not marked “to be determined,” and explain how resources are procured through its regional transmission organization. Starting January 1, 2028 through December 31, 2033, the utility must post yearly progress, the emission cuts, and an updated loads and resources table. The state division publicly verifies the updated plan, and related statutory deadlines shift to match the updated plan timeline.
