Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 0 costs, 3 mixed.

Digital assets enter more criminal-law rules

Beginning July 1, 2026, Connecticut's seized-property and search-warrant rules expressly cover virtual currency and wallets. Stolen property includes these assets and sale proceeds when obtained through theft or other illegal means. Specified criminal laws also treat virtual currency, wallets, and wallet contents as property readily exchangeable for U.S. or foreign money. These changes extend existing legal procedures to digital assets; the search-warrant change alone does not authorize permanent forfeiture.

Digital assets face broader crime forfeiture

Beginning July 1, 2026, Connecticut's forfeiture rules cover virtual currency and wallets tied to specified drug and exploitation crimes. Covered assets include money used or intended for those crimes, proceeds, and property derived from proceeds. Seizures must relate to a lawful arrest or a lawful search that leads to an arrest. Prosecutors must seek forfeiture within 90 days; appropriate notice can be electronic instead of certified or registered mail. Owners and lienholders who did not know, and could not reasonably have known, about criminal use have protections.

Stolen digital assets can repay victims

Beginning July 1, 2026, Connecticut can take virtual currency and wallets tied to specified theft crimes, including mixed-in contents. Assets must be used, held, controlled, or designed for those crimes, or be proceeds from them. Seizure must follow a lawful arrest or search; prosecutors must seek forfeiture within 90 days. The state must prove its case with clear and convincing evidence. Innocent owners, lienholders, and assets used for legitimate defense attorney fees have protections. Forfeited property must cover victims' financial losses. Virtual currency kiosks cannot be seized or forfeited under this rule.
