Beginning October 1, 2025, Connecticut’s environmental commissioner cannot reopen completed cleanup on a specific violation basis at qualifying homes. The parcel must be used only for an owner-occupied, single-family home, and the release must have been discovered and cleaned up. The protection covers reopening based on violations of sections 22a-134qq through 22a-134tt, not every possible reason for reopening.
Beginning October 1, 2025, closure reports verified by licensed environmental professionals count as cleanup verification for the site portion containing the release. For a defined area with several releases, every release needs a verified closure report. Parcel owners can also submit Form III or Form IV verifications without being the party responsible for certifying compliance. That certifying party can rely on an owner's verification after more than one year. The commissioner must either have started no audit or have completed any audit started.
The law excludes a release from being treated as discovered when older data is its only evidence. The data must have been available or generated before the new release-based cleanup regulations took effect. This limits cleanup triggers for responsible parties, but also limits which releases the program treats as discovered. The exclusion does not apply when other evidence exists.
Beginning October 1, 2025, responsible parties gain a route into release-based cleanup for sites investigated under prevailing standards and guidelines. A licensed environmental professional must prepare a report listing every discovered release. Parties must wait at least 90 days after submission, or until the commissioner accepts an audited report, whichever is later. Within one year after submission, they must file closure reports for each release or assign releases to cleanup tiers; releases can be grouped for tier assignment. Instead, they can choose existing cleanup requirements in writing within that year. Any audit must begin within 90 days and finish within one year of report receipt. The commissioner can issue a no-further-obligations letter after all listed releases have closure reports and the report is accepted or the applicable audit period expires.
