More compensation access for people wrongfully imprisoned

Beginning July 1, 2025, Connecticut expands access to wrongful imprisonment compensation through the Claims Commissioner. Claimants must have served some or all of a Connecticut prison sentence, had the conviction overturned, and had charges dismissed. Qualifying dismissal grounds include innocence, grounds consistent with innocence, or serious state misconduct that contributed to the case or imprisonment. Evidence supporting innocence can be newly discovered or have been available during the original case. Claims have a two-year filing window tied to the pardon or dismissal date. Claimants must prove eligibility by showing it is more likely than not; the commissioner must decide eligibility within 90 days after the hearing. An estate can receive compensation if the claimant dies while the claim is pending.

Compensation and limits for wrongfully imprisoned people

Beginning July 1, 2025, base compensation equals 200% of Connecticut's HUD median family income for each year imprisoned. Awards account for inflation using CPI-U, and partial years are prorated. The Claims Commissioner can raise or lower the calculated award by up to 25% based on harms. Listed evidence includes damaged family ties and reputation, crime severity, any death sentence, sex-offender registration and its duration, and other harm. Age, income, job training, and education at conviction are no longer listed factors. The commissioner can also approve payments for job training, counseling, and tuition and fees at Connecticut public colleges and universities. Awards are reduced by damages already awarded by other government units within Connecticut for the same matter; claimants must release related claims against the state. The Attorney General and claimant can agree on facts and compensation; the commissioner must approve and order payment after finding eligibility. Agreed awards requiring $1.5 million or less from the General Fund bypass legislative review. All awards above that threshold require review, with 45 days for lawmakers to confirm, deny, or send them back; otherwise, they are confirmed.
