Bill Overview

Analyzed Economic Effects

10 provisions identified: 6 benefits, 3 costs, 1 mixed.

More sentence credit for time held

Beginning October 1, 2025, people later imprisoned receive credit for qualifying time held before sentencing. This covers charges, including alleged probation violations, filed on or after October 1, 2021. A court detention order, inability to obtain bail, or denial of bail must be the sole reason for confinement. Days count equally against concurrent sentences, but only once against consecutive sentences. People also receive credit for out-of-state imprisonment caused solely by Connecticut's extradition demand. That demand must date from October 1, 2025, or later, followed by Connecticut imprisonment on that matter.

Clearer evidence choices for assault victims

Beginning October 1, 2025, health facilities must obtain sexual assault victims' consent to one of three evidence-kit labels. Anonymous kits omit names and do not report the assault; identified kits include names without reporting; reported kits include both. Police must transfer kits to the state forensic division within 10 days. Identified and reported kits must be analyzed within 60 days of collection; anonymous kits stay stored at least five years. After a later assault report, police must notify the division within five days; analysis is due within 60 days of notice. After analysis, the division may return evidence to police while protecting its integrity. The division or police must keep the evidence until any criminal proceedings end.

Court remedies for immigration enforcement violations

Beginning October 1, 2025, people harmed by covered local immigration-enforcement violations can sue the municipality in Superior Court. This covers violations by municipal police and covered school police or security representatives. Courts can order action to address violations or declare that violations occurred, including past violations. People who win an injunction may recover court costs and reasonable lawyer fees for that part of the case. These cases receive priority for trial assignment.

DNA review protects people facing convictions

Beginning October 1, 2025, the state forensic division must share information from certain DNA samples before removing or destroying them. This covers samples entered in good faith without authority, or records that should already have been removed. The chief state's attorney's conviction integrity unit reviews the information for evidence that could help clear someone. Information found to be exculpatory must reach the charged or convicted person or their lawyer. It cannot otherwise be used to investigate or prosecute.

Lower penalty for first missed appearance

Beginning October 1, 2025, a first second-degree failure to appear is a class D misdemeanor instead of class A. Later offenses remain class A misdemeanors. The offense covers willfully missing a required appearance while released on a misdemeanor or qualifying motor vehicle charge. It also covers willfully missing a probation-violation hearing while on probation for a misdemeanor or motor vehicle violation.

More officials covered by immigration limits

Beginning October 1, 2025, Connecticut's immigration-cooperation limits cover more state officials. These include juvenile probation officers, specified state prosecutors, and people acting for the Board of Pardons and Paroles. These officials must follow the law's existing limits on cooperation with federal immigration enforcement.

Broader legal room for officer force

Beginning October 1, 2025, peace officers' electronic defense weapons are excluded from the statutory definition of a deadly weapon. Their use also does not count as deadly force for the specified state investigation and Inspector General review. Use alone therefore does not trigger that review, but force causing death still requires investigation. Peace officers and authorized corrections and parole officials may use listed neck restraints when they reasonably believe deadly-force defense is necessary. This includes defending themselves or another person from deadly force or its imminent use.

Misdemeanor penalties for uncovered liquor violations

Beginning October 1, 2025, Connecticut sets default penalties for liquor-control violations that have no separately listed penalty. A first violation is a class C misdemeanor. Any later violation is a class B misdemeanor.

More exceptions for immigration enforcement access

Beginning October 1, 2025, Connecticut expands exceptions allowing detention and federal immigration interviews. Arrest or detention based on a civil immigration detainer is allowed with an accompanying warrant issued or signed by a judicial officer. It is also allowed for convictions listed in the law or possible matches in the federal Terrorist Screening Database or similar databases. Federal immigration interviews in custody are allowed for those convictions, database matches, or a court order under 8 U.S.C. 1225(d)(4)(B).

Criminal penalties for allowing underage gambling

Beginning October 1, 2025, the law adds protection against underage online gaming and retail sports betting. No one may knowingly let someone below the legal age open, maintain, or use an online gaming account. The ban also covers letting them place or attempt Internet-game wagers or wagers with a sports-wagering retailer. A person who knowingly allows this conduct commits a class C misdemeanor.
