Limits on workplace surveillance of employees
Beginning October 1, 2026, the law bars employers from electronically monitoring employees in restrooms, locker rooms, lounges, and similar personal-use areas. These rules cover private and public employers and their agents. A limited exception lets outside vendors run cameras for self-service kiosks where workers scan and buy products in lounges. Cameras cannot record sound and must capture only checkout and product display areas. The vendor must keep sole custody of video; employers and their agents cannot share it unless the law permits or requires. Employers and their agents cannot request to view video or use it for discipline unless the vendor reports alleged employee theft. Surveillance violations bring a $500 first-offense fine, a $1,000 second-offense fine, and $1,000 plus 30 days in jail for later offenses. Employers, employees, and their representatives also cannot intentionally overhear or record employment contract talks without everyone's consent. Violating that rule carries a $1,000 fine, one year in jail, or both.
