Defines living donor, organ, tissue

The law sets clear definitions for "living donor," "organ," and "tissue." A living donor is someone who gave all or part of an organ or tissue and is alive. Organs include the eye, kidney, liver, heart, lung, pancreas, esophagus, stomach, intestines, and other parts named by rule. Tissue includes skin, bone, bone marrow, heart valves, sperm, eggs, blood and its parts, and others named by rule. Agencies, medical providers, and insurers must use these definitions.

Insurers can't penalize living donors

Beginning January 1, 2026, insurers cannot deny, cancel, or refuse to issue coverage just because you are a living donor. They also cannot raise premiums or change policy terms for that reason. This applies to life, disability, and long-term care policies delivered or issued on or after January 1, 2026. Insurers may vary terms only when donor status creates actual, unique, and material actuarial risks.
