Insurance protections for HIV prevention users

DC insurers cannot use HIV prevention treatment taken under a valid prescriber's order to issue, cancel, or renew coverage. They also cannot use it to set rates or benefits, or market insurance. Health plans and insurers cannot use HIV prevention prescription records to set an enrollee's individual premium. Health and disability policies cannot single out HIV prevention or HIV-related care for exclusions, coverage limits, deductibles, or coinsurance; limits applying to all benefits remain allowed. Violations of section 4 of DC's insurance discrimination law carry fines of $1,000 to $10,000 each.

Lower costs for HIV prevention care

For DC health plans issued or renewed on or after January 1, 2027, HIV prevention care has no cost sharing. This includes all formulations of PrEP, medication taken before exposure, and PEP, medication taken after exposure. Covered services include initial and follow-up visits, side-effect care, counseling to help people take medicine as prescribed, and CDC-recommended baseline tests. Those tests include chlamydia, gonorrhea, and syphilis testing, kidney checks, hepatitis B testing, and a cholesterol and fat profile. Plans cannot require prior approval or medically unnecessary step therapy, waiting periods, preexisting-condition exclusions, or delays. High-deductible plans may retain cost sharing only to the extent needed to preserve health savings account eligibility.

Dedicated funding for DC health clinics

The DC health department deposits payments for Health and Wellness Center services and affiliated clinic services into a dedicated fund. Payments include insurance reimbursements, patients' out-of-pocket payments, and other collections. The money supports only the Center and affiliated clinics. Money and interest stay in the fund rather than returning to the General Fund at year-end. Appropriated money remains available without a fiscal-year deadline, subject to an approved budget and financial plan; no funding amount is specified.
