The law gives District-licensed architects, professional engineers, and professional land surveyors limited protection from civil damages for volunteer emergency help. Their help must involve their licensed work, at the scene of or connected to a life-threatening emergency. The emergency must involve human-built surroundings, including buildings, transportation systems, or landscapes. Protection applies during a Mayor-declared public emergency or within 90 days after it ends. Volunteers must act in good faith, without pay, and complete training based on California’s Safety Assessment Program. A federal or District official must direct, request, or approve the help; volunteers must reasonably believe the official is acting officially. Protection covers acts and failures to act, but not gross negligence or willful misconduct.
