From July 1 to September 30, 2022, lenders, condo/HOA boards, and tax‑sale buyers cannot start or continue foreclosure, condo lien sales, or tax‑sale redemption judgments if you applied for the DC Homeowner Assistance Fund (HAF) or a similar COVID‑19 fund and show proof your application is under review, pending approval or payment, or under appeal. If you applied before September 30, 2022 and your case was still pending that day, and you provide proof, you remain protected until HAF pays or your appeal is finally denied. The Mayor provides applicants documents to prove HAF status to creditors and works to speed HAF payments to cure eligible debts.
Starting July 25, 2022, any foreclosure cannot move forward until 30 days after the first warning notice is sent. Before September 30, 2022, warning and foreclosure notices must be sent by mail and email, tell you about the DC Homeowner Assistance Fund, list the specific debt, and explain the September 30, 2022 HAF application deadline. On or after October 1, 2022, notices must still be sent by mail and email and include HAF information and the debt type. If a notice sent before November 22, 2022 lacked HAF details, a new notice with HAF information must be sent before foreclosure continues. The Mayor posts editable sample notices with HAF details for lenders, associations, and tax‑sale buyers to use.
