New housing built with the District’s Housing Production Trust Fund must meet Enterprise Green Communities Certification Plus or an equivalent set by the District. These projects must be all-electric, with no combustion equipment except emergency backup power. The rules apply only to new construction, not to substantial rehabilitation as defined in the Rental Housing Act of 1985. They remain in place until final Clean Energy DC building code rules take effect.
When a project builds new housing or replaces or repairs 50% or more of a roof, it must add rooftop solar or other on-site renewables if feasible. The rule does not apply if there is inadequate sun, essential rooftop equipment or amenities take the space, or structure, shading, or design limits make it impracticable. The Department of Buildings or the Department of Energy and Environment set these limits in rules.
The law takes effect after mayoral approval (or a Council veto override) and a 30-day congressional review. The entire law expires 225 days after it takes effect.
The Green Building Act updates a phrase about net-zero duties. It removes 'shall maintain net zero energy compliance and fulfill' and now says 'shall fulfill.' This is a wording change and does not set new numbers or funding.
